In the event of a car accident the companion of the drunk driver is to bear 30 percent of the blame, as stipulated by the Greek Supreme Court.
According to the local traffic regulations, a driver is under the influence of alcohol when the blood test shows a concentration of over 0.5 parts per thousand in his or her body or above 0.25 parts per thousand in the breath, when a technical device is used for the test.
The court took the decision while considering a case of an accident in which three other people had been travelling in the car of a drunk driver. The accident caused injuries to the passenger next to him in the chest and abdomen and the subsequent internal bleeding caused his death.
His family had filed a claim for compensation for mental harassment and for reimbursement of the funeral costs but according to the court, the relevant amount should be reduced by 30 percent.
The reasoning of the decision of the senior judiciary states that "the person killed was aware that the driver had consumed alcohol and therefore that his ability to drive the car had been reduced. The fact that the passenger had accepted to get into the car and be transported by the driver makes him an accomplice in the offence."
